In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using this website.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for any amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT:

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

REFUND POLICY:

After you have ordered through PayPal (our payment gateway), then you can get a thirty day refund with no reason.

To initiate a refund within thirty days after ordering, you can make a request in an email sent to Rich at richcanadianteacher@kidcantalk.com and make sure to supply us with the receipt of payment that you received from PayPal. Within 24 hours after your refund request is received, you will get a full refund on the Services you ordered if you had yet to use the Services. If you did use some of the Services, then you will receive a partial refund on the remainder of the Services that you didn’t use, but do keep in mind that you can transfer any of the Services you didn’t use to the appropriate person.

LATE OR MISSING REFUNDS (If Applicable):

If you haven’t received a refund yet, first check the account you used to make the payment and then contact PayPal, as there is often some processing time before your refund is officially posted.

INCOME/PROJECT DEADLINE DISCLAIMER & REFUND POLICY:

The approximate amount of time (a minimum of 5 minutes and then rounding down or up to the nearest multiple of five) that your coach invests into hosting your web conferences, while also emailing and messaging you is recorded in an up-to-date spreadsheet and you can request a copy for your own records at any time. Further, your coach tracks how long it takes him to critique and verify your work, offer optimization advice and when doing outsourced work for yourself, he always takes note of the time it takes him to finish the job and everything gets totaled up.
